Terms of Service
Effective October 20, 2026
These Terms are an agreement between you and GYSS ("GYSS", "we", "us") and apply to the GYSS app and gysstraining.com (the "Service"). By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you don't agree, don't use the Service.
1. Health and fitness disclaimer
GYSS is not medical advice. Workouts, programs, calorie and macro targets, nutrition estimates, and everything MILO says are general fitness information, not a diagnosis or treatment. Talk to a doctor before starting a new exercise or diet program, especially if you are pregnant, injured, or have a medical condition. Stop exercising and get help if you feel pain, dizziness, or shortness of breath. You exercise at your own risk.
2. MILO and estimates
MILO is an AI coach. Its answers are generated automatically and can be wrong, incomplete, or not right for you. Calorie and macro values, including estimates from photos and food databases, are approximate. Use your own judgment and don't rely on GYSS for medical, allergy, or dietary decisions.
3. Eligibility and your account
- You must be at least 13 years old. If you're under the age of majority where you live, a parent or guardian must agree to these Terms.
- Give accurate information and keep your email account and devices secure. You're responsible for activity on your account.
- Usernames must not impersonate others or infringe anyone's rights. We may reclaim or change a username that does.
- You can delete your account at any time in Settings > Delete account.
4. Your content
You own the content you post or upload, such as photos, videos, posts, comments, and messages. You give GYSS a worldwide, non-exclusive, royalty-free license to host, store, display, and share that content only as needed to operate and improve the Service and as your settings allow. This license ends when you delete the content or your account, except for copies others have already shared or that we must keep by law.
You're responsible for what you post and confirm you have the right to post it.
5. Community rules
Keep GYSS a place people want to train. You agree to follow our Community Guidelines. There is no tolerance for objectionable content or abusive users. Don't:
- Harass, threaten, bully, or hate on anyone.
- Post nudity or sexual content, graphic violence, or anything illegal.
- Promote dangerous practices, such as steroids or other illegal drugs, or extreme dieting or eating disorders.
- Spam, scam, impersonate others, or sell things without our permission.
- Post content you don't have rights to.
- Hack, scrape, reverse engineer, overload, or interfere with the Service or other users' accounts.
We use automated tools and human review to enforce these rules. We may hide or remove content, limit what an account can do, and suspend or permanently ban accounts that break them. You can report any post, story, comment, message, or profile, and block any user, from the ••• menu in the app. We review reports promptly, usually within 24 hours. You can also email brogan@gyssfitness.com.
6. Our service
GYSS, including the app, design, logos, exercise library, recipes, and MILO, belongs to us and our licensors. We give you a personal, non-transferable, revocable license to use the app for your own non-commercial use under these Terms. We may add, change, or remove features. We may also suspend the Service for maintenance or other reasons.
7. Third-party services
GYSS works with services we don't control, such as Apple Health, Sign in with Apple, Google Sign-In, map providers, food databases, and retailer links. Their terms and privacy policies apply to your use of them, and we aren't responsible for them.
8. Paid features
GYSS is currently free. If we offer paid subscriptions, they'll be billed through the App Store, and the price and terms will be shown before you buy. You can manage or cancel a subscription in your Apple ID settings.
9. Ending your use
You can stop using GYSS and delete your account at any time. We may suspend or end your access if you break these Terms or put other users or the Service at risk. Sections that by their nature should survive, such as disclaimers, limits of liability, and dispute terms, continue after your account ends.
10. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't promise that the Service will be uninterrupted or error-free, or that any results, such as weight loss or strength gains, will be achieved.
11. Limitation of liability
To the fullest extent the law allows, GYSS and its owners, employees, and partners aren't liable for any indirect, incidental, special, consequential, or punitive damages, or for any personal injury, lost data, or lost profits arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or $50. Some places don't allow these limits, so they may not fully apply to you.
12. Indemnity
You agree to defend and hold GYSS harmless from claims arising from your content, your misuse of the Service, or your violation of these Terms or anyone's rights.
13. Apple App Store terms
If you downloaded GYSS from the Apple App Store, these Terms are between you and GYSS, not Apple. Apple has no obligation to provide maintenance or support for the app and isn't responsible for the app, its content, or claims relating to it, including product liability, legal compliance, or intellectual property claims. If the app fails to meet an applicable warranty, you may notify Apple for a refund of the purchase price, if any. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm that you aren't in a country subject to a U.S. government embargo and aren't on any U.S. government list of prohibited or restricted parties.
14. Disputes
These Terms are governed by the laws of the State of South Dakota and applicable U.S. federal law, without regard to conflict-of-law rules. Before filing a claim, please contact us so we can try to resolve it informally. If we can't, any dispute will be handled in the state or federal courts located in South Dakota, and you and GYSS consent to their jurisdiction. Nothing in these Terms limits rights you have under consumer protection laws that can't be waived.
15. Changes
We may update these Terms. If we make material changes, we'll let you know in the app or by email before they take effect. If you keep using GYSS after that, you accept the updated Terms.
